Terms of Service

These Terms of Service ("Terms") govern your use of the TryStat platform operated by Kruger Design Studio ("we", "us", "our"). By creating an account or using TryStat, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. The Service

TryStat is a software-as-a-service platform that enables schools and rugby programs to capture live match events, generate reports, and track player development. The service is accessible at app.trystat.co.za.

2. Eligibility and Accounts

You must be at least 18 years old or an authorised representative of a school or sporting body to register an account. You are responsible for:

  • Providing accurate registration information
  • Keeping your password secure
  • All activity under your account
  • Notifying us immediately of any unauthorised access at support@trystat.co.za

3. Subscription Plans and Billing

TryStat offers free and paid subscription plans. Pricing is published at trystat.co.za/#pricing and may be updated from time to time with at least 30 days' notice for existing subscribers.

  • Paid plans are billed monthly in South African Rand (ZAR)
  • Payment is by EFT or other methods as offered. Invoices are sent to the school's billing email
  • Late or non-payment may result in suspension of paid features
  • Free trial periods do not require payment, but conversion to a paid plan requires explicit upgrade

4. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months. To cancel, email billing@trystat.co.za.

5. Plan Limits

Each plan has limits on the number of teams, games per season and other features. Limits are enforced by the system. To increase limits, upgrade to a higher plan.

6. Acceptable Use

You agree not to:

  • Use TryStat to violate any law, including POPIA
  • Capture or store personal information without lawful basis or required consent
  • Attempt to gain unauthorised access to other schools' data or our infrastructure
  • Reverse-engineer, copy, or resell the service
  • Upload malicious code, spam, or content that infringes third-party rights
  • Use the service to harass or harm any individual, particularly minors

We reserve the right to suspend or terminate accounts found in violation.

7. Your Data

You retain ownership of all data your school enters into TryStat. We process your data on your behalf as described in our Privacy Policy. You can export your data at any time in CSV format.

You are responsible for the accuracy of data you enter and for obtaining the necessary consents from players, parents and staff before capturing personal information.

8. Service Availability

We strive to keep TryStat available 24/7 but do not guarantee uninterrupted service. We may schedule maintenance windows with prior notice. We are not liable for interruptions caused by:

  • Internet connectivity issues
  • Third-party service outages
  • Force majeure events

9. Intellectual Property

The TryStat platform, its design, code, branding and documentation are the property of Kruger Design Studio and are protected by copyright and other intellectual property laws. You receive a non-exclusive, non-transferable licence to use the service while your subscription is active.

10. Limitation of Liability

To the maximum extent permitted by law, TryStat and Kruger Design Studio are not liable for any indirect, incidental, consequential or punitive damages arising from your use of the service. Our total liability in any 12-month period is limited to the fees you paid us during that period.

The service is provided "as is" without warranties of any kind, except where required by South African consumer protection law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.

12. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated to school admins by email at least 30 days before they take effect. Continued use of the service after changes means you accept the new Terms.

13. Termination

Either party may terminate this agreement at any time. We may suspend or terminate accounts that violate these Terms. On termination, your access ends and we will delete personal information per our retention policy after a reasonable export window.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
